1) About the Platform
Qwik Stories (“Platform”) connects clients with independent creators (photographers, videographers, influencers, entertainers). The Platform is operated by Qwikverse Technologies Private Limited (“Company”, “we”).
2) Acceptance
By using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
3) Accounts & Eligibility
You must be 18+ and able to form a binding contract.
You’re responsible for your account and any activity under it.
4) Our Role
We provide discovery, booking, and payment tools.
We are not a party to the contract between Clients and Creators. Creators are independent and solely responsible for their services.
5) Bookings & Payments
Prices, packages, and availability are set by Creators.
Taxes and any Platform fees (if applicable) may be added at checkout.
Payments are processed by third-party processors; their terms apply.
6) Cancellations & Refunds
Each booking follows the Creator’s stated policy.
Platform fees (if any) are typically non-refundable unless required by law.
7) Content & IP
Your uploads: You keep your rights, and grant us a limited license to host and display them to operate the Platform.
Deliverables from Creators: Ownership and usage rights are as agreed between Client and Creator. If not specified, Client gets a limited license for the agreed use case only.
Platform IP: All Platform materials and trademarks belong to the Company or licensors.
8) Acceptable Use
Do not break laws, infringe rights, post unlawful or abusive content, bypass fees, scrape, hack, or interfere with Platform security or operations.
9) Reviews
Reviews must be honest and respectful. We may remove content that violates these Terms or the law.
10) Disclaimers
The Platform is provided “as is” and “as available.” We don’t guarantee uninterrupted service or outcomes, and we aren’t responsible for actions of Clients or Creators.
11) Liability Limit
To the extent allowed by law, we’re not liable for indirect or consequential damages (including lost profits/data). Our total liability for any claim related to the Platform is limited to the Platform fees you paid to us in the 6 months before the claim.
12) Indemnity
You’ll indemnify and hold us harmless for claims arising from your use of the Platform, your content, your breach of these Terms, or your dealings with others on the Platform.
13) Suspension/Termination
We may suspend or terminate access for policy or legal violations, suspected fraud, or security risk. You may stop using the Platform at any time.
14) Changes
We may update these Terms at any time. The updated version applies once posted with a new Effective Date. Continued use means you accept the changes.
15) Governing Law & Disputes
These Terms are governed by the laws of India. Courts in Hyderabad, Telangana will have jurisdiction, subject to any mandatory consumer rights.
